The Legal Definition of DUI/OVI in Ohio
OVI charges may involve not only motor vehicles but also non-motorized vehicles like bicycles or horse-drawn carriages.
BAC (blood alcohol content) legal limits depend on the driver’s age in Ohio. Drivers 21 or older will usually be charged with OVI if a breath test reveals a BAC of .08 and up. Drivers under 21 may face OVI charges for blood alcohol content as low as .02.
If you get pulled over on suspicions of OVI, always cooperate with the police and answer all required questions. Avoid volunteering information as it could incriminate you later.
What Happens After OVI Conviction in Ohio
If an Ohio court convicts you of OVI, the penalties may depend on various circumstances. For example, first-time offenders may often expect less severe punishment compared to repeat offenders.
OVI laws in Ohio distinguish between standard OVI charges (blood alcohol content between .08 and 0.16) and high-test, or aggravated OVI (blood alcohol content of 0.17 and higher).
Standard OVI Penalties
● First offense: Up to 6 months in jail, up to $1075 in fines, and license suspension for 1-3 years
● Second offense: Up to 6 months in jail, up to $1,625 in fines, and license suspension for 1-7 years
● Third offense: Up to 1 year in jail, up to $2,750 in fines, and license suspension for 2-12 years
Aggravated OVI Penalties
On top of the standard penalties mentioned above, Ohio drivers convicted of high-test OVI (BAC of 0.17 and up) may also expect the following punishments:
● First offense: A minimum of 3 days in jail and 3 days in an intervention program
● Second offense: A minimum of 20 days in jail, or 10 days in jail and 36 days of house arrest with monitoring
● Third offense or greater: A minimum of 60 days in jail, or 30 days in jail and 110 days of house arrest with monitoring
Additionally, multiple OVI convictions (four offenses within 10 years or six offenses within 20 years) may cause Ohio courts to classify the offense as a felony. A felony conviction could lead to a lengthy prison term, extremely high fines, and permanent license suspension. An OVI conviction will stay on your Ohio driving record forever.
